| Angry Landlord not treating me fairly!! | Tenant | ||

I moved in a rental home on April 1st and on april 2nd I noticed a water leak from the ac I called the landlord and he came over and did what he called fixed the problem and it happened again and again and again for about a month straight .. then the problem got progressivly worse and eventually he hired a ac person to come who told him that he needed a whole new unit .. he and his wife claimed I BROKE THE AC !!! and that I could either pay half to get a new one , get several window units and pay for them or move out , I decided to hire another ac company for a second opinion and they said alls we needed was freon which the landlord paid for . They never apolized for that and since then I have had a water leak problem that was causing a nasty smell in the bathroom which is connected on the other side of the wall with the kitchen sink , when I called the husband told me to call the city ?? and claimed the pipe in the street was clogged about a two week period went by and the problem go worse and long story short he tried to fix it himself and that ended up taking over four days before a plumber was hired to fix the problem ,.. I have since then had financial problems but I have told him I would be able to pay him late and that I could pay it every second wed with a late fee if needed that I had no choice and now I am being told I need to pay 10 percent of the rent as a late fee which I did not do ! I paid them 50 dollars , now I am noticing mold in the hall closet and I have been feeling all clogged up and my son is sneezing etc and I am pretty sure its from the mold .. I tried to call him several times and he has not returned any of my calls !! I feel like since I have paid late twice that he is purposly not calling me back now .. and its not about the rent its about the mold problem .. I want to break the lease now , I am angry and feel that I am not being treated with the respect I deserve I would never rip anyone off but this whole rental situation seems unfair to me < I do not think he has been a very good landlord and has not done his share of what is expected but yet he is mad about a late rent .. do I have any legal rights to get us out of this place ? |

| Noise and Heat in the apartment. | Tenant | ||

I moved to an rental apartment 2 months back and have signed a lease for 1 yr. I am facing below problems and want to move out from apartment with security deposit. owner is NOT ready to give security deposit amount saying that you are breaking the lease. 1. There is continuous noise/sound of machineries and boilers located below this apartment because of which we are not able to sleep and concentrate on any routine activities.

I have been with my apartment complex in Albuquerque, NM since May. We signed an 8 month lease and it ends as of January 31st. However, I do not want to stay that long. I don’t feel secure in staying for a few more months. Several times we have placed work orders for maintenance to fix a door or our ceiling fan (the light no longer worked!). It took 4 weeks for them to even go LOOK at the fan. They said they would replace it the following week but never did. Two weeks later, there was a leak, apparently from our master bathroom toilet, which flooded our apartment and the apartment below us. The call went to the office around 10am. I leave for work at 5am and don’t use that bathroom other than for showers.
THe office never recorded our new contact numbers from months before. They were always able to get ahold of us through our agent/alternate contact, but not on this day! They never notified us of the problem. Maintenance went in the apartment and ruined things with their negligence. They threw wet items all over the bed, onto the living room floor, filled backpacks with expensive electronic equipment and left it in puddles of water.
I didn’t come home til after 6pm and when I did, I had no knowledge of what happened. My apartment was thrown upside down. The carpet was torn up and a blower was running to dry underneath. All of the lights (that worked) and fans in the house had been running all day. All without our knowledge.
I took a complaint to my apartment manager who said it was our fault. The negligence was on OUR part because we “left the water running”. I asked him if I was supposed to shut the water to the toilets off everytime I left the house. He said it was a leak we didn’t report. And why? BECAUSE IT WAS A LEAK WE HAD NO KNOWLEDGE ABOUT. When I left for work that morning, there was nothing out of place. The floor in the bathroom was completely dry. He refuses to take any responsibility for the fact that nobody bothered to contact us, the fact that the maintenance men were negligent and not only ruined things on their own (NOT due to water damage directly from the leak), and that they left all electricity running for 8 hours, using up resources that WE have to pay for.
On top of all of this, and the reason I really don’t want to stay… The master bedroom, where the carpet was lifted for the blower, smells like mold. It’s damp (two weeks later) and smells moldy. The apartment manager refuses to work with us at all. What can I do to either make him work with us or get our of our lease so we can move somewhere SAFE and free of mold?

I was recently denied on an application to rent an aprtment and was told that it was my backround check that was the issue. The only thing on my record are misdemeanors or traffic issues. What are the guidelines for approval or for being denied. |

| Landlord Bed Bugs! | Tenant | ||

I can’t sleep! … knowing that hundreds of bed bugs are waiting to attack is the worst living nightmare! I feel like I’m going mad! This is a desperate plea for help. For the last couple of months I have been getting more and more bed bug bites. At first it was just a couple of bites that I though was from a spider or something, but now I wake up with hundreds of bites. I can’t take it!! Can anyone help me? What can I do? These bed bugs have infested my rental unit and I don’t know what else to do. Look at this picture, isn’t it gross!! I’ve been fighting with my landlord about getting him to treat my rental unit, but he refuses. He keeps saying that I need to deal with it. I checked into it and it will cost anywhere from $800 to $1400 for bed bug removal, OUCH! To be honest I can’t afford it, but at this point I will do whatever is need to get a good nights sleep. What should I do? Should I move? Should I hire and Attorney? Should I Admit myself to the psych ward, no joke, its getting that bad! What are my options as a renter when it comes to bed bug removal? I saw you can file a complaint here (with RPA) but is there a way to file a bed bug complaint?
I admit it, I’m desperate… What should I do? Your advice is so needed!! I think I’d rather live with monsters in my closet than with thousands of bed begs hiding in every corner waiting for me to go to sleep. Please help!!! |

Hi, We live on second flr of rented apartment. We got a complaint from the leasing office that one of the neighbours (lady on the first flr) is disturbed with noises coming from our home. We know that we are not making any noises other than walking on floor. How can we defend such complaints in the future? I am scared that the neighbor might complaint again and may call cops as well. What are my options for such over-sensitive neighbours? What is the worst the landlord can do to me? Thanks, NG |

| Bed Bugs and Landlord Responsibility | Tenant | ||

I recently notified my Landlord of Bed Bugs and asked him to please fumigate my apartment. He is very adament about not paying. I not only was lucky enough to capture one in a plastic bag but have documentation of lesions on my body. A pest control technician came out searched my apartment to determine the severity. He quoted the fumigation process between $700 and $1200. I have been legally disabled and out of work for 3 years. I am on state assistance and can not afford to fumigate my apartment. I am having major anxiety attacks as well as pain from the itching. Please help me and let me know what my rights are. Please also send me any links that will provide me with more support and my renter rights. Thank you Thank You Thank You I am literally being eatin alive.

I have caught my landlord, Sam Dea entering into my house in Mt. Washington twice. The first time he trespassed into my house I was fully asleep. A few months later he did it again. He didn’t give me 24 hours notice. He just simply let himself in. I am female and the only tenant on the lease. Besides moving, what legal rights do I have to prevent this from happening a third time? I went to the LAPD and all they suggested I do was to file a restraining order. Can I sue my landlord for violating my tenant’s rights? |

I signed a 12 month lease on June 1, 2009. I gave notice and am moving out Nov 12th. I did pay $1500 Security (one months lease) at the inception and I did pay the whole month of November. My issue is that my Landlord is now putting up the house for sale and not advertising or entertaining a lease. What would my rights be as a tenant? If I am liable for the term of the lease doesn’t this seem wrong that they will not actively persue a tenant? At this rate: I paid Nov. in full Kind regards, |
