If a tenant improvement, authorized by the landlord, makes the space out of fire code, is it the responsibility of the landlord or tenant to pay to put space back into code?

So you are saying that you are the one that made the change and because your landlord was nice enough to allow you to do it, that it should somehow be his responsibility to fix your mistake?

Sounds a bit off doesn’t it?

If you are the one that made the error, then you should fix it or be responsible for the cost regardless of landlord permission or not. Ultimately, the landlord will need to fix it, but you will most likely be held responsible for the cost.

To put it into perspective:
Let’s say your landlord allowed you to have a Dog. Your dog then rips up the nice wood floors in the family room… Who should be responsible? The dog owner or the landlord? Yep! The tenant is responsible. Its crazy for you to think your landlord should be responsible for you making the unit a hazard. All I can say is take some responsibility for your actions.

I have a wood burning fire place the chimey has been cleaned only once in 5 years . How dangerous is this and should the landlord be responsible ? This complex has about 80 apartments.

I have my house in mountains, and per safety issues, the chimey should be cleaned every year. As for who’re responsibility that is, ask the landlord nicely and that should take care of it, if not go above him/her.

Hope it helps.

Vicky
