dishonest landlord kept my deposit, I never signed lease

A landlord kept my deposit and first months rent even though I never signed the lease, can he do this?  How do I get my money back?  I refused to sign the lease because the property was not the property as he had describe it.

SB MAIN Has BED BUGGS

Carpet Resposibility

I am moving out of an apartment where I have lived for 5 years.  The carpets were new when I moved in but now have some damage and need to be replaced.  My question is if I am responsible to pay for the total cost.  It was estimated at $1,200.
