Dear Sir / Madam,

I rented this apartment about a month ago and have been plaguing by the noise from the aircrafts – daily – due to the fact that the apartment is in close proximity to the Sky Harbor Airport Flight Path.

I understand that land lord is not required to let me know that the apartment is in the flight path but my question is, is land lord required to fit the apartment with better noise protection insulation?

Can you please advice?

Thank you.

To answer you question: No.
Landlords are not required to do anything different than what the building codes would require for their area. Rentals that are close to Trains, Freeways, or Airports are typically lower cost in order to accomodate for the undesired noise. This really requires some due diligence on your part. Never sign a contract without knowing what you are getting into– I always suggest knocking on a few doors in the area before agreeing to rent.
You may want to see if you can break your lease… if its driving you crazy it would be worth a shot.
