I moved to an rental apartment 2 months back and have signed a lease for 1 yr. I am facing below problems and want to move out from apartment with security deposit. owner is NOT ready to give security deposit amount saying that you are breaking the lease.

1. There is continuous noise/sound of machineries and boilers located below this apartment because of which we are not able to sleep and concentrate on any routine activities.
2. I have a 4 yr old son and since we are not able to sleep in night, it has effected on our health.
3. There is a high temperature in an apartment compared to other apartments in the building even though heater is NOT on.
4. When an apartment was taken from owner, heating system of building was NOT on and the idea of boiler room locating below this apartment was not given to us.
