Noise and Heat in the apartment.

I am facing below problems and want to move out from apartment with security deposit. owner is NOT ready to give security deposit amount saying that you are breaking the lease. 1. There is continuous noise/sound of machineries and boilers located below this apartment because of which we are not able to sleep and concentrate on any routine activities. 2. I have a 4 yr old son and since we are not able to sleep in night, it has effected on our health. 3. There is a high temperature in an apartment compared to other apartments in the building even though heater is NOT on. 4. When an apartment was taken from owner, heating system of building was NOT on and the idea of boiler room locating below this apartment was not given to us.

That is correct, you would be in breach of your lease agreement. The 4 items you listed are probably a nuisance, but hardly anything that would allow you to get out of your lease early. This is one of those buyer beware renter stories. Sometimes you never know what you’ll find after moving into an apartment. There is no law that requires a landlord to disclose heater locations.

I hear your pain! (pun intended) I’ve got a train that zooms past my rental unit every 15 minutes all day. I never thought it would be this bad, but wow, is it loud. Its a bit more difficult for me to blame the landlord… I knew the tracks were there when I toured the unit. Kind of sucks! I feel your pain, good luck.
