Problem

TN Apartment Complaint

We have been renting our apartment for almost a year now and had planned on renewing our lease (already turned the papers in to renew it) We have a 2 year old and a 4 year old both boys. My problem is the lady downstairs came to us and said that the kids were causing her walls to shake. When we moved in we requested a bottom apartment because I knew our kids were rowdy and they have a hard time sitting still but we were told that we got what we got so we were put in a 2nd floor apartment. The lady below us keeps hitting her ceiling (our floor) with something and it makes our floor literally move when she does it. Yesterday I had a baby sitter here watching the kids while I ran an errand and the kids were being rowdy and she came up here calling my baby sitter names and tell her that she was going to get us evicted. During the cold weather it isn’t like I can take my kids outside to help the release some of their energy. Anyone have any suggestions as to what I can do about this? It is to the point to where I don’t feel like this is my home anymore because of the fear she will complain.

The problem is that all tenants are entitled to quiet enjoyment, so if your kids are loud enough that other tenants are not able to enjoy their quiet enjoyment, then you could be evicted.   There’s not really a good fix for this.  Noise problems are always going to be a problem for tenants living in large complexes.  

I suggest you come up with some solutions for your kids.  Even though its winter, you can still take them to indoor like areas where they can get the wiggles out, such as libraries, stores, Mcdonalds Play place, etc.
Personally, if I were you… I would not renew your lease and find another unit that is more suitable for you.  With this economy you may be able to find a small home in the same price range you are paying for your current apartment.  I sure wouldn’t want to have to worry about complaints either.  But, the facts are that you may be evicted if your kids continue to be a problem for other tenants.  (even if it is an old lady)
