Moved out and broke lease a month early due to excessive mold and resulting respritory illnesses. Made landlord aware of mold and he procceded to paint over mold in which it grew back shortly. Landlord said I could move out and if I cleaned apartment my deposit would be returned minus the rest of the month's rent($200). Landlord now refuses to return deposit due to broken lease. Also, apartment was cleaned however, landlord states it was not cleaned because of "dirt" on walls. "Dirt" on walls is in fact mold.

MOLD PROBLEM: Landlord stated that a water line had been leaking from the air conditioner. He was not aware of the problem until mold had started to grow. Landlord claims he took care of the mold as soon as he found out, therefore there is no cause to state that this is the reason the tenants moved. Tenants had told him that they could no longer afford the unit and needed to move. |

LANDLORD JUSTIFICATION: Landlord stated that he can collect for the entire lease term, but was nice enough to allow the tenant to break the agreement early. The forfeited deposit is more than fair. Landlord is not willing to refund any of the deposit since the tenants breached their agreement. |

LANDLORD RESPONSE: Landlord states that the tenant had a one year lease which was terminated eary due to the tenants relationship separation. Tenant requested to move early since the rent could not be afforded by one person. Landlord allowed tenant to break lease early but charge the deposit as a lease termination fee. |
