COMPLAINT : Issuance of unwarranted noise disturbance complaint
Fair Resolution according to renter :
  1. Removal of unwarranted and unproven noise disturbance allegations from our rental history. Also reimbursement for RPA fees.

COMPLAINT DETAILS (from renter)

We live in a townhouse style apartment, two levels with a basement. No one lives above or below us. Our landlord contacted by phone months ago regarding a complaint from one of our neighbors that they heard "banging" and "stomping" coming from our apartment. We have 3 children under the age of 5 so the use of child safety gates on our stairway is essential to their safety. Our only guess is possibly they are hearing when these gates shut, however they are by no means loud even in our own apartment. We then received another call from the landlord manager who again received another complaint of the same nature, from the same person. We just received an official "warning notice" from our landlord manager citing "excessive noise" during the afternoon of 3/16/2011. We feel at this point it is becoming harassment from our neighbor/landlord manager because as a working family with 3 young children, we are typically in bed by 9 or 10 pm and do not create disturbances beyond normal children just playing. Nowhere in our lease did it state that we would be unable to use safety gates for our children, nor did it state we would be subjected to harassment for doing so. The landlord has never received any complaints from the neighbor on the other side of us, reaffirming the fact that this is probably more of a personal issue this neighbor has rather than a valid complaint. We have held a flawless rental history, free of any noise or any complaints for the 6 years we have rented properties.
