Landlord May 4, 2011 68.188.100.13 As the Property Manager of Cherry Creek Apartments, I have been authorized to respond to this complaint as follows: On February 8th, 2011, Christopher Hertzelle took possession of 316 Hickory Hedge Drive. We are confident that there were no bed bugs present in the unit at the time. When we were notified that he currently had an insect problem, we had his apartment exterminated, at no cost to him, within72 hours and our exterminator took a sample of the insects that the resident had saved for him to determine what they were. When we were notified that the insects were, in fact, bed bugs the tenant was notified that our exterminator was available the following day to perform a treatment specific for bed bugs but that he would be responsible for the cost since the insects were not present when he moved in. During my phone conversation with the tenant on 4/30/11, he implied that he would pay for the next day's extermination and requested a letter specifying what would happen (regarding his responsibility for costs) if further treatments were necessary. The extermination was completed on Friday, 5/1/11, and at that time we had the surrounding apartments inspected for bed bugs since the tenant stated that he thought they must have come from another apartment. There were no other bed bugs found in the surrounding area. We have taken all necessary steps to rectify this problem and we standby our initial decision that Mr. Hertzelle is responsible to repay us for the cost of this treatment. His apartment will be reinspected, at no charge, by our exterminator on Thursday, 5/5/11, to determine if further treatments are needed.
