COMPLAINT : breach of the implied habitability warranty due to bed bug infestation

COMPLAINT DETAILS (from renter)

Adjoining dwelling recently treated for Infestations. Within 24 hours bed bugs were biting me in my living quarters. Other bugs were also found and caught to be identified. Apartment Lease Contract states that residents must pay for treatment at their own expense. Neighbor must be held liable of this infestation and required to cover cost of relocation, cleaning, pest control treatments (Apartment Lease Contract Attachment: Bed Bug Addendum; paragraph 8). Other expenses which I require compensation are needed to prove cleaning and treatment to management satisfaction; personal property, furniture, clothing and possessions must receive treatment according to accepted treatment methods established by a licensed pest control firm approved by management (Apartment Lease Contract Attachment: Bed Bug Addendum; paragraph 9).
