COMPLAINT : property damage due to closet flood and bed bug infestation
Fair Resolution according to renter :
  1. Lanlord should pay for extermination fee of $486
  2. Termination of lease with no penalty. (No lease termination fee)
  3. reimbursement for lost/damaged property due to closet flood, including clothes and shoes.
  4. Landlord should return security deposit

COMPLAINT DETAILS (from renter)

I moved into my apartment on May 5, 2012. On May 10, 2012 I began to notice little red bugs on my bedroom wall. Initially, I thought they were ants so I just sprayed with Raid. Despite my attempt to fix this problem, a few days later, I noticed a few on my bed. At that point, I called the front desk attendant and filed an extermination request. The exterminator first came out on May 23rd. He left me a note saying that he conducted and inspection and determined that there were no serious issues in the apartment and did a general spray down. This helped for a little while as I did not notice any bugs for almost two weeks. On the week on May 31st these bugs resurfaced in my bedroom and I continued to spray and clean in attempt to eradicate this problem. On the week of June 4th I once again called the front desk attendant to file another request I was advised to catch one the bugs and to save it for him. He was scheduled to come on June 13th. I followed the instructions and saved two bugs in a ziplock bag. On Saturday June 10th around 1 pm after taking a shower, I went into my closet to grab some clothes, when I noticed that the shirt that I grabbed was damped. This is when I noticed that my entire closet was wet; my clothes, my shoes, documents in my closet, etc. I immediately called maintenance emergency and one of the guys showed up a little while later. He inspected my closet and my bathroom and wasn’t sure where the water was coming from. He asked me to get my property out of the closet as he tried to figure out the source. He went back and forth from the apartment upstairs and mine and finally told me that they weren’t going to figure out what the source of the flood was until they open up my bedroom and bathroom wall. Since it was Saturday, I had to wait until Monday during regular maintenance hours as the work would be extensive. I spent the rest of the weekend, tossing away ruined clothes, doing laundry and airing out my apartment. I lost over $400 On Monday evening when I came home from work I noticed that the work was not started and that my closed and bathroom wall were still stained with mildew and water. I called maintenance and they said that they were coming on Wednesday. This was the same day that the exterminator was to come. On June 13th, I came home and noticed two notes on my kitchen table. The other note was from maintenance saying that they could not fix the flooding issue due to the infestation and will not fill any maintenance requests until the bed bug issue is over. I spent the next couple of days preparing for the extermination; doing over $100 worth of laundry, discarding bed sheets and purchasing mattress and box spring encasements. All of my property had to be placed in black trash bags indefinitely.
The exterminator came out that Friday and did the first spray down. He told me that he would be back in two weeks for the second treatment. I spent the next couple of weeks, losing sleep and being subjected to the smell and sight of mildew in my home. Even worst, I continued to see these bugs and sustain bug bites. I contacted the exterminator about this and he said that it was normal and that he would be back on Jun 29th.
On June 29th the exterminator came back out and did the second treatment. Days after his visit I noticed bugs crawling on the bed and wall. Once again, I contacted him about my sightings and he said that this was all part of the treatment process and to be patient. He was scheduled to come out on July 13th for the last treatment.
On July 13th the exterminator came out for the third treatment. For a few days I didn’t notice bugs, bites or feces until Monday morning. As my alarm clock rang, I reached over to turn it off and noticed one crawling on the bed. Since that day I have noticed a few more and blood spots on my sheets. That Monday, I contacted the exterminator once more and he did not offer an explanation as to why I was still dealing with this issue at the end of the treatment. He told me to keep a look out and that he would come back in a few weeks to check what’s going on. The situation with my closet and bathroom has only worsened. The mildew and mold on my bathroom and closet walls are only worsening and this issue is agitating my asthmatic condition.
The exterminator employed by Presidential City Apartments has been inefficient in eradicating the bed bug infestation and I don’t believe that I should have to pay for an apartment in which I cannot live comfortably. I have lost clothes and shoes due to the flooding and have spent hundreds of dollars in dealing with a bed bug infestation. Aside from the physical risks from bed bugs and mildew, the stress and anxiety has compromised my health. Prior to moving to Presidential I had never had a problem with bed bugs. Within less than two weeks of moving to presidential, this problem arose. Between the plumbing issues that caused the flood in my closet and the bed bug infestation, I believe that I was given an uninhabitable apartment. For those reasons, I wish to terminate my lease. These living conditions are unacceptable.
