COMPLAINT DETAILS (from renter)

My roommate and I moved out of our apartment on May 10th. Our contract ended on the 25th. My roommate emailed the landlord about the security deposit early June and the landlord replied saying she need to get the receipts since we left a mess in the apt - she says she needs professional cleaning for the floors, counters, painting the walls, etc. This doesn't make much sense to us because we didn't wear shoes in the apt and we didn't live in the apt that much. But we waited. 2 months passed and we didn't hear anything from her. My roommate emailed her but never got a reply. So I called her and left a message asking if we could meet in person to talk about the deposit (i didn't want to talk about it over the phone since it could easily get rude). I left another message the next day. The day after she texted me in the morning saying, "Just send me your address". I replied, "Hi Lisa, could we meet in person?" She replied, "No. I am busy this weekend and I work all next week. Then going out of town" I replied "Okay, that's alright. How much were you planning on sending?" She never replied. That conversation was on Saturday. I haven't heard back from her since. I called her on Monday, but she did not pick up. I'm not sure what to do from here.

Renter Aug 19, 2012 72.92.31.34 I appreciate the response, Dan. Lisa’s previous resolution said “feel free to call the contractor”. So I called his number 2 times. I did show up at his door, but I didn’t know that Edgar lived there before his roommate introduced us. Additionally, I did not break or bang on any doors, nor did I have anything to do with the broken exterior door. I have friends who live in the condominiums. I also never stepped onto your private property. I gently knocked on the door and Edgar’s roommate answered. In addition, Edgar told me to call him because he wanted to speak with me. But I told Edgar that I didn't want to speak with him anymore and that he could text me if he wanted to. I just wanted to clear the above claim. I am willing to settle with the $900. I am not happy with it considering what I have been through this past month. Please send the check to me and my roommate to our respective addresses.

Renter Aug 8, 2012 12.174.18.202 1.) I do not agree with the claims made regarding the conditions in which we left the apartment. I would like to see receipts dated, priced, with the phone numbers of the company providing the claimed service(s). I have politely asked to discuss the security deposit refund amount on multiple occasions, and to see the itemized receipts but have been ignored every time. (Records of ignored calls and ignored texts attached) 2.) Regarding the file attached by the landlord: The email that is attached is not what it seems. Although Edgar’s profession is a contractor - he is not the contractor of the apartment. In fact, I met with him in person and he is the current tenant of the apartment. When Edgar and I spoke regarding the painting/carpet cleaning, Edgar said “You shouldn’t have to pay for that”. I’m guessing this is why the landlord has not shown receipts - because she did not actually hire these workers. Edgard, the current tenant, did. 3.) According to the contract, the security deposit was due back to the tenants (less any repair costs) within 10 days of the lease ending on 5/20. (Contract attached) We moved out of the apartment on 5/8. 4.) The landlord visited our apartment March 25th at 11AM to change our water filter. At that time, landlord saw the loose screws on the cabinet/drawer, and verbally stated that they needed to fix it. 5.) I texted the landlord about the clogged toilet the morning after it happened on May 8th. I received no response from her. (Ignored text attached) 6.) In addition, my roommate emailed the landlord about the security deposit on April 29th regarding our respective addresses that our security deposit would have been refunded to. Landlord replied to that email (meaning that she received) but ignored the contents. (Record of email also attached) 7.) Because of the above conditions (fraudulent use of email, poor communication from landlord, and a security deposit refund late over 2 months), my offering resolution is a full refund of $1350. If appropriate and honest communication is not established, I will consider using additional methods.
