We do not sleep on our bed due to main infestation. The mattress, box spring, and pillows are covered with vinyl coverings. The walls are blank also due to the infestation. Picture taken 11/12/12

COMPLAINT : Bed bug infestation
Fair Resolution according to renter :
  1. The property manager will take responsibility for all treatments including heat and freezing treatment.
  2. I request the units in the complex be treated (including heat treatment) in order to elimate reinfestation.
  3. I want the property manger/exterminator to publicly notify the units in the complex of the infestation found in this unit.
  4. I am requesting that the first months paid rent be reimbursed due to cost of proactive measures such as throwing away vacuum bags daily, washing bedding daily, purchasing totes to put clothes in, garbage bags purchased to put items in, and for compensation dealing with the stressful situation.
  5. . If the infestation cant be controlled and /or property manager refuses all the listed above resolutions we are requesting to be released from our lease with including heat treatment for our unit so we can take our belongings to another apartment and we are requesting our full security deposit back

COMPLAINT DETAILS (from renter)

We moved in Monday 10/29/12. Two days later on Wednesday 10/31/12 my fiance sent me a picture and a text notifying me that he had a rash on his body at 6:07 am shortly after he had arrived at work. I talked to my mother who asked me to ask my landlord Michelle if the previous owners had pets. Maybe indicating that they were flea bits. Michelle notified me that they did not. I told her these bugs had appeared on my one wall by my bed mostly. She asked us to catch one and bring it down to the office, which later my fiance did but she was no longer in the office. The next morning 11/01/12 she contacted me asking if she could look around in the apartment. My fiance and I had found 6-7 more around 4 am when he gets up for work. I had those ready for Michelle to look at when she came to see the apartment. She thought they were bed bugs and notified Valley Pest Control to come deem that, that is what they were. They did a chemical treatment that day, which was 100.00 billed to our account. On 11/03/12 my mother and I sat down with Michelle to express our rapid infestation growth and the impossibility of us bringing them in. She said she would expect the adjoining units by us and notified us that she had not found anything. On 11/07/12 around 11:00 am my fiance's job notified him that he had to get a doctors note saying the rash was not contagious before he came back to work. We talked with my hotel to verify that they did not come from there and I was provided a note from the pest control specialist stating that the hotel was clean from any bug infestation. I will be receiving one from my previous landlord stating the apartment was good for occupancy also. The situation has not gotten better since the first treatment. I usually find multiple at night around 11:30 when I get home from work. We received these sticky straps that do not have anything in them to attract bed bugs. The Valley Pest control gentlemen came back in today 11/12/12 to ask us how things were going. We notified him that things have not going good and that I had found around 20 of them last night 11/11/12 around the window and bass boards. They appeared very small just past the newborn stage with a tiny amount of blood in them. He notified us that he was going to spray the bass boards in our room because that is where they are mostly located and to see how that would good. My mother took a picture of a shell that they shed. We have pictures, texts, messages documenting events.

SYSTEM Mar 26, 2013 FORCE REQUIRED! After repeated attempts to resolve this complaint; management has FAILED to comply and requires force. The RPA has taken all reasonable efforts to contact the Landlord / Manager. They have REFUSED all request and will require FORCE. This case is closed with a negative disposition.

SYSTEM Dec 4, 2012 ADDITIONAL INFO FROM TENANT: Michelle had two other exterminator companies come into the home in the last week to get a total of 3 opinions. The last one came in today 12/04/12. She called me shortly after he had left the apartment and said that Wil-Kil would be doing a Heat treatment Monday 12/10/12. She said they would be paying for the heat treatment to help us and their property. She acknowledged that she had gotten the RPA's letter but would not be accommodating the request such as months free rent etc. She also said if we were not satisfied after she would be happy to let us out of our lease. I am very appreciative that she is taking these measures but I would like to add like i stated in the first complaint we moved in 10/29/12 and have been dealing with this since 11/01/12, basically since the start. We did not bring this into the apartment. She had said this heat treatment is an almost guarantee because they take off the base boards and etc. I understand that, but I wanted to state if we did not bring the problem here than in the future it is not guaranteed that they will not return because chances are if we are having this problem and did not bring it, the problem would have to have arrived from a different unit or previous renters and we are paying the consequences such as living out of totes, bags, vacuuming everyday, and our electric bill, and our house does not hold a "homey" feel as of now.

SYSTEM Nov 27, 2012 UPDATE PROVIDED TO CHAT SUPPORT: After the exterminator came in on the 11/12/12 my fiance Andrew got these large welt looking marks on his stomach and higher thigh area. We believed that it was an allergic reaction to the chemical treatment the exterminator had done the previous day, as these marks showed up the very next day 11/13/12. This was not confirmed by a doctor, it is just our assumption. We continued to be proactive seeing if things would clear up after the chemical treatment just in the bed room. (Vacuuming everyday, keeping clothes in garbage bags and totes, looking for bugs multiple times a day, washing blankets and clothing everyday). This did not clear up. I think partly the reason is he only sprayed the base boards in our bedroom versus the whole apartment, as they are in the whole apartment. On 11/19/12 the exterminator came in and treated the whole house for the second time. I had asked before they started if the chemical treatment was only effective on adult bugs because that is what I found in the research I did. They said it will not destroy the eggs but the plan is to chemical treat today and come back and treat again to get those eggs that hatched. I did not fully understand because I thought more would be reproducing in that time period. As the exterminator was there, there was a few out on the walls of the in the living room and kitchen. My landlord even spotted on the floor before she left. The exterminator was asking if they were always this high in my apartment, as they were basically on the ceiling. Most of them I find around 11-11:30 at night far out of reach. (On the ceilings, on top of doors etc). I use my vacuum or climb on tables to get to them. My exterminator looked in my walk in closet in my bedroom and seen that we had an attic. He came to the conclusion he thought they were bat bugs and since the bats are now gone they are feeding off of us. Later that day my landlord Michelle called me and said she talked with the exterminator and she was going to have two of her maintenance men come up and look in the attic the next day. Which Michelle states they found nothing. Later that night 11/19/12 we found 20 - 40 bugs to say the least of all sizes. They seemed as if they were trying to escape from the chemical and that is why so many had come out. She called 11/26/12 to see if improvement has been made. I told her honestly no but explained to her that we were still being proactive as I explained in the paragraph above. She has not stated anything about taking financial responsibility nor has she stated what will be happening in the near future. That does not mean she is not planning on doing something I am just not aware of what is going to be happening.
