It should also be noted that, when the expert came out on 2/5/13 to inspect the unit for bed bugs, he found NO EVIDENCE of prior infestation on any of our property/furniture (including this sofa and our master bedroom mattress) that we, the lessees, just moved into the unit - further indicating that problem was at the unit BEFORE we moved in. |

The expert mentioned throughout this report came to the unit on 2/5/13 to do an inspection. His name was Tommy and he was from Lady Bug Pest Control in Dayton, OH. He CONFIRMED the bug in the photos here IS a bed bug. He also stated he was 98% an active infestation was present and that the unit was most likely previously treated. |

We know that bed bugs often colonize in room corners. It seems strange that this wallpaper was put up in just the right place to cover any evidence of activity. |

This was a corner in the master bedroom where the expert said the most activity was. He said the dark spots were fecal matter left by the bed bugs and they were definitely in the apartment at some point. |

Upon moving into the property at 1084 Beryl Trail, evidence was found (live bugs) that the unit had a bed bug infestation. After seeing several of these bugs, the landlord/management agreed to send an expert to investigate the problem, who subsequently discovered bed bug activity within several rooms of the unit and estimated that the unit had been infested BEFORE the current lessees (Dustin Moses and Teri Ledford) moved in. In addition, we, the lessees, believe the unit was previously treated for bed bugs by management, which was not revealed to us upon agreeing to take possession of the unit. We believe this violates the implied habitability warranty that the landlord/management shall provide a safe and livable unit. Furthermore, the landlord/property management has verbally denied knowledge that the unit was ever infested. Even if a neighboring unit, or this unit in question itself, we believe the landlord/management has a responsibility to inform tenants/potential tenants of that knowledge. We believe that the landlord/management may have attempted to "cover up" the current infestation by denying knowledge, installing items in the unit that would assist in covering up visual cues of an infestation (new carpet, wallpaper). Furthermore, we assume that the landlord/management, regardless of the provability of the items above, accepts full responsibility for the infestation. The landlord/management has already received the same report from the expert mentioned above as we did. They then did not hesitate to attempt to contract out work for an extermination company to come spray the unit and try to contain the situation. We, the lessees, have researched bed bugs and know that they can be hard to get rid of (in many cases you can never get rid of them), or trying to sufficiently contain them can be trying on one's health both physically and mentally. We do not wish to go through any of this, especially with a 9 month old baby living with us. It is our with that our lease with the landlord/management be dissolved, and all concerned parties release from further contractual obligation. We would also request reimbursement for contaminated property that we would leave behind upon move-out (for which management would be responsible for disposing). Lastly, we would also request reimbursement for any medical services rendered to use as a result of the infestation, as well as any monies already paid to management (all deposits and rent). |
