COMPLAINT DETAILS (from renter) |
Tenant observed the presence of bed bugs and notified the landlord.
Landlord returned call to notify tenant that Exodus Exterminating would be taking care of the issue.
Inspector arrived from Exodus exterminating on March 12, 2013 (approx. 1:30pm) and observed the infestation. Origin of bed bugs was inconclusive. Inspector instructed tenant on prep for extermination, which tenant performed.
Landlord called tenant (12:11pm, March 14th 2013) to inform tenant that tenant would have to pay. Tenant did NOT agree to pay.
Tenant called (1:23pm, March 14th 2013) to instruct landlord to schedule extermination.
NYS law mandates landlord provide livable space - that must be bed bug free - under Warrant of Habitability Law .
By not incurring the cost of the extermination, the landlord is failing to do so. Since the origin of the bedbugs cannot be determined to be by the tenants actions, the tenant acknowledges no responsibly for the infestation and seeks to withhold rent for reimbursement for breach of warranty, or be reimbursed by the landlord directly..
