COMPLAINT : bedbug infestation and charge tenant for the bedbug treatment
Fair Resolution according to renter :
  1. Pay all the fees related to bed bug treatments including $544.38 charged by ABCO examinating Corp on 7/8/13 and any future cost
  2. Make an appointment with the pest control company for the second treatment for my apartment in 1 week
  3. Eradicate bed bugs in 30 days
  4. If the landlord is not agree with 1-3, break the lease and refund me the $1200 deposit
  5. Reimburse my rent 30 days from now to the day the problem is solved

COMPLAINT DETAILS (from renter)

I reported bed bug issue to Rosedale Management Company on June 24th. The management company responded quickly and called the ABCO Examinating Corp to examine my apartment and I was told that all the cost will be on them. ABCO Examinating Corp came on July 1st to spay the apartment. However, I still got bites and caught another bed bug on July 8th. I reported the incidence to Rosedale Management Company on July 9th and requested a second spray of my apartment. By July 12th, I didn't hear anything from either the management company or ABCO Examinating Corp. I got a mail on July 12th from Rosedale Management Company stating that " it is likely that you brought the bedbugs with you when you moved into the apartment. Therefore, you are responsible for the cost of the treatment. I felt uncomfortable about the statement and about the possible accusation by the Rosedale Management Company. It is illegal to charge the tenant for the bed bug treatment cost. Also, the landlord is responsible to eradicate bed bugs in 30 days.

2. 1) I didn't move in until June 10th, which is the day I got the keys 2) The floor is not well sealed 3) Neither me or superintendent found the bed bugs in the dresser. Rather I found bed bugs on the floor and wall. 4) Bed bugs or not: I totally caught 3 bed bugs in my apartment. Two of them were handed to the superintendents, one on June 24th and other one is on July 8th. I was told by superintendents that those two bed bugs were shown to the inspector and the inspector confirmed they are bed bugs. 5) Please check www.nyc.gov for your responsibility ("Your landlord is legally required to get rid of bed bugs in your apartment within 30 days.
