In the spring, our basement flooded due to a dysfunctional sump pump. There was a discussion to increase the strength of the sump pump. The decision was to divert the water next to the deck This resulted in highly muddy conditions for about 10 feet, making it hard to use the yard because of the mud and mosquitoes. We complained verbally after, in person in June, and in July over the phone.

We bought our own brown carpet to cover up the preexisting condition of the living room/dining room and to prevent risk of damage. We have several images over time. Living room carpet removed 6 days ago.

COMPLAINT DETAILS (from renter)

We have had initial problems with our landlords providing the property in a suboptimal state (with carpeting and paint was in need of imminent replacement in certain rooms and lack of thorough cleaning) as well as frequent reluctance or accusatory behavior when repair issues came up thereafter. At the initial rental, Mr. Upadhyaya verbally acknowledged many defects of their property (as well as assuring us of our nonliability for those preexisting) but never provided us formal documentation of those things despite our repeated verbal request. We are scheduled to move out on 7/31/2013. We requested a walk-through to which they agreed on 7/27 (today). They came, but literally refused to speak with us upon entering (and told us that they were under no obligation to speak with us) or to discuss our main concern (that the wear and tear related to our 2 year occupancy) not be used to justify repair of many, preexisting faults with a house that was only in fair condition at the outset. They took pictures of new and old issues, and walked throughout the house without permission, despite our repeated requests that we have the opportunity to discuss things during the walk-through. We felt this behavior was highly inappropriate since we have paid rent early, and done many things that the landlords did not do for us (ie. clean the house thoroughly, carpet cleaning, purchasing rugs and fixtures, and maintain a home shield warranty contract after their accusatory behavior regarding minor repairs). There has been a tense relationship over repair issues on and off for two years. More recently, dysfunctional sump pump has created swamp conditions in the yard that has rendered it unusuable for the last three months. Our main concern is the behavior of the landlords is inconsistent with a scheduled walkthrough, and suggestive that intend to claim more of the $2195 security deposit than is appropriate. A supervised walk-through (landlord-tenant conversation) ideally with an independent party present might ensure a more constructive and fair interaction, ideally before the last date of tenancy.
