COMPLAINT DETAILS (from renter)

Landlord did not tell us about the major flooding problems in all of the rooms of the apartment. Before moving in he said that only one corner of the front bedroom got wet. This room was also carpeted and quickly began turning black, along with the baseboards and Windows. On Memorial Day weekend I told David when I saw him outside about the MAJOR FLOODING issue in the front bedroom. I'm telling him this while him and his friends are drinking from a keg in the driveway at 12 noon, so I knew what I said was falling on deaf ears. I have had open heart surgery and have a compromised immune system, and my doctors told me I had to vacate the apartment ASAP! Landlord also said that it would be just his immediate family staying upstairs. One week after moving in landlord moved in guys from the outage crew. These were guys that he didn't know at all, he just did it to collect the check. They were very loud and much sleep was lost because of this. They would party, and again that put a big strain on my body. Landlord failed to mention the fact that the septic tank would back up and all the smell would be in our bathroom. The day we were leaving he said oh yeah, I failed to mention that. There were many days I was sick on my stomach and would end up vomiting profusely because of the smell. No amount of air fresheners, opening windows, etc. would help. One day we were gone running errands to return to see him intently peeping in the kitchen window. How comforting for me as a woman to see this! My health rapidly got worse while living there, and upon me being admitted to the hospital, Jake DID inform David that we would have to be leaving soon. We wanted to stay close to Oak Island but finding rental property was tough. As soon as we did find somewhere we informed him we would be leaving. Because of my severe health condition and me having to get out ASAP we only gave 6 days notice. We just received a letter and he is refusing to return the deposit, which mid you, he promised he would be returning to us once he inspected the apartment and was satisfied with the condition. He just said he didn't have the money right then, which we said was fine. After weeks passing though we realized he had no intent of returning it. He just lied, like he did when we move in. He also as I that if I would have informed him of my health, he would have advised us not to move in. We never expected for this place to be such a cess pool.
