On August 21 our notice to vacate was submitted to Ms. Rowe. Following her receipt of the notice, Ms. Rowe spoke to my husband, Mike, via telephone and expressed that she was caught off guard by our sudden decision to move and that we would be held accountable as per our lease terms for any rent due, utilities, etc., until the official expiration of our lease on May 15, 2014. Additionally, she said that William E. Wood would seek a judgment for monies owed in court as necessary.
During that conversation Mike expressed to her that the responsibilities of the property manager to oversee necessary repairs and for the owner to maintain the property in a safe, fit, and habitable condition had been violated repeatedly with her knowledge over the last 3 years. My husband then mentioned the number one issue at hand; compromising the overall health and wellbeing of our family, to include our 7 and 9 year old children, by not properly inspecting and remediating the clearly existing issues of mold, mildew, and rot that are a result of large amounts of water entering the house via leaky and bursting pipes and a roof that had been leaking for at least a year. The water from the leaking roof not only entered the attic of the house, it also poured between multiple walls and down through the ceiling of the second floor affecting the electrical outlets located on multiple walls around the home. Additionally, there are multiple other repair issues including, but not limited to, the back gate having been held closed with a bungee cord for more than a year, the backyard flooding, both front and back doors do not fit properly in frames and there is a 1/2" gap in backdoor, etc.
