COMPLAINT DETAILS (from renter)

I lived in the apartment for 23 Months. I started with 6 months lease (Oct-2011 to March-2012)...this lease was followed and expired without any dispute. After March-2012 I went on month-to-month for next 6 months (April-2012 to Sep-2012) ...again this was followed without any dispute. From Oct-2012 to March-2013 I stayed for 6 months without any dispute. In March 2013 i told landlord about my intention of staying for another 6 months, Since my wife delivered baby in Feb-2013 and my job was coming to end (I work as a contractor) , I needed some time to look for another job...New job could have require relocation. I describe my situation to Landlord and Landlord offered me option of increased rent (increment by +$125) and agreed over the phone about me moving out before the end of six month (Sep-2013), provided I give 60 days notice. I was unemployed for almost 2 months (meanwhile I paid my rent on time)...In July I gave 60+ days notice about vacating apartment by the end of Aug-2013...finally I moved out on Aug -17-2013 . Now, I am keep getting bills from Halfpenny Management for the amount of $1445 ($1025 September Rent + $420 Damages Deductions). Landlord, is accusing me that I breached the original (Oct-2011 to March-2012) lease terms and asking me to pay the balance to avoid going to collection agency. Truth is : 1. Original lease was followed and expired. 2. I gave over 60+ days notice to landlord, and vacated apartment on Aug-17-2013...Thus, gave ample time to landlord to find new tenant and avoid vacancy. 3. I agreed to unreasonable rent increase , Because landlord gave me flexibility of vacating apartment before Sep - 2013 (With 60 days notice). 4. There are absolutely no damages to apartment. 5. Minor wear-and-tear in the apartment are result of 23 months long residency. Thus, I owe $0.00 to Halfpenny management.

SYSTEM Oct 8, 2013 LANDLORD EXPLANATION: The Landlord Ann Motz cannot accept the tenant's resolution nor provide an alternate resolution as per the statement provided: In a letter dated March 26, 2013 signed by Mr. Saravate, he requested that his Lease be renewed for 6 months (from April 1, 2013 to September 30, 2013). He signed a legal document on March 26, 2013 entitled "Short Term Lease Agreement" stating the Lease would begin on April 1, 2013 and end on September 30, 2013. This document does state that Mr. Saravate also was required to give 60-days written notice as required by all Residents. If a Resident decides to vacate prior to the Lease expiration date, they are required to pay the remaining months as per the Lease. Mr. Saravate was on a 6 month Lease, vacated 44 days prior to the Lease expiration date, and paid his rent through August 31, 2013. Therefore he is resposible to pay the remainder of his Lease term which is $1,025.00 for September's rent. Also, Mr. Saravate was charged $420.00 in damages/deductions. In a letter from Halfpenny Management Company dated September 25, 2013, Halfpenny Management Company informed Mr. Saravate that we would waive these charges as a courtesy. However, he is legally bound to the Lease Agreement for September's rent which is $1.025.00.
