COMPLAINT DETAILS (from renter)

I moved into college court 3 months ago, and since day one I have been battling a bed bug infection. We have undergone 3 treatments over 3 months, and still the problem persists. Tenants are experiencing issues sleeping and staying asleep. Very itchy bite marks all over the body. For the sake of the mental health of the tenants, we plead the management to terminate our lease.

Explanation: Management given opportunity to do heat treatment months ago; requested after first failed chemical treatment, management initially refused and made very clear it is something they were not interested in doing. Time and cooperation provided to management company is more than reasonable given the circumstances. Tenants no longer feel safe in unit 2208. 3 months in current conditions, tenants have suffered: 1) Countless painful and itchy bites from bed bugs 2) Loss of furniture, clothing, and bedding as a result of bed bugs 3) Inability to sleep without fear of suffering bed bug attack 4) Extreme emotional and psychological trauma as a result of bed bug infestation 5) Costs associated with post treatment requirements 6) Exposure to harmful chemicals over long period of time Issue and resulting pain and suffering occurred imediatley upon moving into 2202D. Initial unit was infested with bed bugs and deemed not habitable, which was acknowledged by management with in less than 24 hours of move in. Moved tenant to new unit since original unit posed extreme health risk. Tenant was not given any instructions and simply told to move, infestation soon followed. New tenant moved into original unit despite management being informed of infestation, show casing the lack of care and extreme negligence of the College Court staff. College Court staff has failed to produce work orders for the 3 failed chemical treatments, as well as their accompanying MSDS documentation even after multiple requests were made. Tenants have a right to know the health risks they are being exposed to as a result of these harmful chemicals, many of which are deemed to cause health damage with only short exposure. As a result of the negligence of the College Court management staff and Asset Campus Housing upper management, at least 8 people spanning at least 2 units have suffered at the hands of this infestation. Full of extent of infestation not currently known; soft investigation underway. Given the time, money, pain and suffering the tents have suffered, as-well-as the well documented display gross negligence at the hands of the College Court and ACH staff, a fourth treatment is not an adequate resolution to this very serious mater. SYSTEM Nov 6, 2014 ALTERNATIVE RESOLUTION BY LANDLORD: The Landlord; Amber Dukes has offered the tenant an alternate resolution. The resolution purposed is: 1. Management has already scheduled a heat treatment of the unit for November 10, 2014 per the residents request.

Explanation: Management scheduled treatment of the unit (spray) through our contracted pest control service. The instructions state that there must be follow up treatment no less than 14 days after the initial treatment and several treatments may be required. After 3 spray treatments, resident Kavheh Saramont complains that he has still seen live bed bugs and requested a heat treatment be scheduled. Our management has moved forward with meeting that request to resolve the issue to the resident's satisfaction. In addition, Saramont has been the only resident to have bed bugs in their living space. Management has already scheduled a heat treatment of the unit for November 10, 2014 per the residents request. A follow up inspection will still occur no less than 14 days after the treatment.
