COMPLAINT DETAILS (from renter)

Since 8/15/2014 Maria E. Magana has maliciously retaliated against us since exercising our Tenant Rights under California State Law to have a contractually agreed upon, hazardous repair completed. We entered into a lease contract with Maria Magana on 8/10/2013 for the property located at 13281 January Court, Corona, CA 92879. Maria Magana breached that contract when she failed to complete the East Side Gate Repair that was a material part of the contract. When we agreed to rent this property, we only agreed to rent if Maria Magana not only agreed to the repair but stated it in our lease. Maria understood we would not be able to live comfortably or leave our dogs safely unattended outside unless the East Side Gate was repaired. All of our attempts to have Maria Magana resolve this matter have gone ignored. After exercising our rights, we were denied lease renewal after receiving a letter as well as an email confirming that Maria Magana wanted to renew our 1 - Year lease. We were being pressured to purchase the home for $400k and when we declined, we were pressured to start looking for a new place. We were given various different notices of time lines to vacate the property after we exercised our tenant rights, from month - to - month, to 24 days, to 60 days. We were told that we would be given our security deposit back in full on the day we vacate, she then redacted that offer as another form of retaliation. Anytime that we looked into our rights and made Maria Magana or her agent Nancy Sotelo aware of our rights, Maria retaliated. Now she is attacking us through our security deposit, holding us responsible for damages and petty things that we are not responsible for, so we have no alternative but to escalate this matter to the appropriate agencies. I'd also like to note that we are not the first tenants to experience this with Maria Magana. Her prior tenants, our neighbors on the opposite side of the East Side Gate, Rick and Rhonda Shinnamon have also experienced almost identical retaliation from Maria Magana. They were asked to move by Maria Magana, her claim to them was that she would be moving back into the house, only to subsequently rent the property to us just a couple of weeks later at a higher rent amount. They are open to discussing their own experience with her and have provided their direct contact number if needed. Because there are so many details to this case, we will provide all evidence as requested. Thank you.
