COMPLAINT : Breach of Agreement - Unsafe Living Conditions for me and my 4 yr old

  1. I want to move out, receieve my refund back and not have this reported as an evictions. I also want them to pay for relocation fees.

They have given me notice to vacate within 5 days and I have to appear in court.on Sept 27th. I received a notice from the Rankin Court Clerk on Sept 22. I paid my rent on time which was Sept 2, 2010 - the apartment complex failed to check the drop box and therefore assessed me a 95.00 late fee. They are saying that I owe $1482.66 with a breakdown as follows: cable saver program 80.00 -- I have my own account with Comcast pest 9.98 trash 15.98 water 17.96 base rent 950.00 (with showing 933.00) prorated gas charge 16.22 late fee 95.00 not only that -- I paid the power bill in the amount of 76.31 of which they have not applied to any of my bill The resolution that I seek is the return of my deposit and to move out with no monies owed since I am living in unhealthy conditions. When I first moved in Grady the manager informed me that there would be no charge for cable unless I choose to have extended channels and internet. They have proceeded to charge me anyway at 40.00 a month.
