Giving landlord notice

My rent is due on the 15th of each month as per my lease agreement. I did not pay my rent for April 15, but can catch it up on May 15th with my regular payment. On May 5th, I received a 3 day notice to vacate due to non payment of rent for April and May and May is not even due yet. I called my landlord and spoke to his wife who handles the accounts. I told her that my payment is not due until the 15th, as per my rental agreement…she said that she remembered that I had moved in the middle of the month in August, but thought I had not paid a full month’s rent. but I was still late for April. Is the notice she sent still valid?

Hi Anntonette,
If the lease agreement can be a proof of the date you moved in then show that to her! Let them know the facts. Try to explain to them your side. Maybe when you went there she was having a bad day. The validity of their notice depends if they will pursue it legally. Just prepare when they’ll take it to another level.Seriously, I am sorry you are having so much trouble. I hope everything works out.
