If the divorce is final you may have to file an unlawful detainer. Although you do not have a rental agreement with your ex husband he technically is considered a tenant depending on how long he has lived there. You may have to go thru the eviction process with the state your in.

However since you or your agent has changed the locks on the door you may have opened yourself up to a unlawful eviction lawsuit. If you no longer own the building I would let the new owner or financial institution worry about it. If the house is in foreclosure and your going to lose it, why care?. He will eventually be charged with trespassing if he does not leave. Hope this helps.
