Yes. And if you move into a new lease and they are not present, notify landlord in writing and if nothing is done, you may withold 25 dollars per day for the time you were without from may 1st to october 1st. I did this and didnt pay rent from nov 1st to january 1st, needless to say, feb 1st, screens installed on every window.

According to florida statue screens must remain in good repair…whether that includes screens on windows you could probably argue yes. If they are there they need to be in good repair without large holes. Now if you complain I do not know if they can just remove them and that would satisfy the law cause I do not know if they are required.

“Where there are no applicable building, housing, or health codes, maintain the roofs, windows, screens, doors, floors, steps, porches, exterior walls, foundations, and all other structural components in good repair and capable of resisting normal forces and loads and the plumbing in reasonable working condition.”

Florida Statute 83.51

The quick answer is no.

Window screens are a cosmetic issue and not required. The government can not mandate how a property needs to look unless it is a health concern or hazard. While you can have bugs and things enter through a window without a screen, its not a major health concern as you have the ability to shut the window.

Now, if the window was stuck open, then you would be more likely to get your landlord to fix it, even with force. However, missing screens on your apartment or rental home are not regulated.

If it bugs you that bad, you could always file a complaint with the RPA. It will cost you $35, but might get your landlord to finally install those screens. Good luck!
