new managment taken over

By susan bezanson

I have lived in my apartment complex for three years now. Recently the property was taken over by a new company. For the past three years  because of my financial situation being a single mother and mental illness(which I am on meds and under a  Doctors care and not only doing well but flurishing i might add )  my very nice Father has loaned me a car with insurance included (in his name) to help me out and i have been issued a parking permit and have parked on the property with no problems. now this company has sent a letter stating that if the registration and insurance is not in my name I will either be towed for parking on the property or have to park off site. the offsite parking is basically non existant due to many apartment complexes and close proximity to the University. If i were made to park offsite it would be an extreame heartship due to occasional mental unbalnce, having a young child and being a female walking alone perhaps late at night. I basiically have hace been happy here but this new managment company with these new enforcement are being kindof aggressive in their tactics. The property manager talks to me in a very condecending manner and calls me "sweetie" and hunny" in an almost belittling way. i dont want to stir up trouble but I do want to know if i have an argument or options. Thank you in advace for your tiime and advice.

Thank you,

Susan B and Son

I can understand your frustration with wanting a close parking space for your apartment. You may be protected if there is a lease agreement that includes the parking space. Just because an apartment building is sold or under new management does not give them right to alter a prior agreement. They are required by law to honor any existing agreement you had.

Check your lease agreement and see if it includes the parking space. If it does, then you are safe. You won’t have to worry about anything they say no matter how much they talk down to your or attempt to force their new rules. If they do, you can politely refer them to your lease agreement.

What ever you do DON’T sing a new contract!!! This is the oldest trick in the book. When a new property is bought or under new management often times the manager will come around telling you that you need to sing the new agreement– DON’T! By signing a new agreement of any sort, you may be giving away rights that were previously granted to you under the old agreement.
