I think if part of the deposit was titled a &quot;Last Months Deposit&quot; you can and should use it for your last month.  But if it is called a security deposit or something like that, you are screwed.]]></description>

		<description><![CDATA[Deposits cannot be used for rent.  A deposit is a security that you will leave the property in good condition.  Regardless of how much of a deposit you paid, it is still a deposit and nothing else.  If you&#039;re stating that you over paid your deposit... this is something you should have worked out when you moved in, not 1.5 years later.
You can&#039;t use any of your deposit towards rent.  Look at the lease dealing with deposits, I&#039;m certain it will spell this out.]]></description>
