				<content:encoded><![CDATA[<p>We just moved out of an apartment that we used very lightly. During today&#8217;s move-out inspection the landlord claimed we would have to pay for new carpet and new paint&#8230;the carpet and paint are exactly as when we moved in except for 2 small carpet stains (on an old carpet that was not replaced when we took possession) and otherwise very minor wear and tear after a year of use.  Our questions:<br />
(1) what is considered normal wear and tear,<br />
(2) on average, how many years of normal use does a typical apartment carpet get before the <strong>Rental management </strong> assumes responsibility for its replacement, and<br />
(3) is it typical for the cleaning deposit to be used to pay for the routine carpet cleaning done by management upon a tenant&#8217;s move-out?</p>
<p>The management today would not itemize and present their estimated costs of our move-out.  We think they expected us to agree to whatever figure they pulled out of the air today.  We refused to pay anything until we get an itemized list of costs. They said they have 21 days to provide us with an estimate of our costs.  Is that true?</p>

I was under the impression that if you had resided in a propery for a certain time period things such as carpet and painting weren&#8217;t the tenants responsibility. Does anyone know of any legalities pertaing to this issue or have any advice on how to better research this.</h4>

He called me the next day and was extremely rude to me and degrading of family members so to avoid a fight i said i would be out by weekend my rent was not due till Friday august 1st.  I had to go t owork that friday night and when my mothjer went by there to finish the cleaning she was told that we were not allowed back in to clean. I have never lefta rental property uncleaned and was planning on cleaning including steam cleaning carpet but ws not allowed to. and was told that tyhey plan opn suing me for the carpet being dirty. What are my rights? I am worrying myself sick over this matter have been depressed and sick for a week now</p>

				<content:encoded><![CDATA[<p>My family recently moved from a house. We asked about getting deposit back from landlord and they refused. Let me try to explain this a little bit so you understand.</p>
<p>We moved into this house thinking it was a great house. We lived there for a year and a half. Over this time stuff started to fall apart. Within two weeks of moving in, I called the person over that showed us the house to point out a few things that we had noticed one thing is the carpet and markings on the walls. He told me not to worry about any of it that we would not be charged. He has since passed on. Other things happened while we lived there. Mold grew in different areas in the house, my daughter&#8217;s ceiling started to fall, my son now has allergies, and the master shower could of fell at any time through the floor. My daughter&#8217;s light acted up and it was fixed within a week. It was a wiring issue. There was a wiring issue in a hallway light that they did not fix before we moved. We moved out before the lease was up due to all the issues in the house.  But still, shouldn&#8217;t we get our deposit back?</p>
<p>I asked for the deposit back. They came back and told me that I owed them for the carpet that I told them about in the beginning, as well as want us to pay for all the repairs in the house.</p>
<p>I am trying to find is how much a tenant should pay for carpet. I am also wondering should a tenant pay for what they pointed out to the landlord as issues though out the occupancy?</p>

				<content:encoded><![CDATA[<p>i am at the end of my lease and would like to know the fl. state law of replacement of the carpet. i have rented this apt. for three years and the carpet was at least one year old when i moved in. i was told  the law is replacement every four years of carpet in a residental rental home in fl however i wanted to be sure this is the actual law.   it seems like there should be some type of carpet depreciation for apartments.  how often does a landlord have to replace carpet?  if anyone can help i would greatly appriciate it.</p>
