Basement apartment having damp smell

Hi,

I moved into a basment apartment 2 days back. The apratment is having a damp smell and keeping us awake all night. On complaining the apartment manager asked us to use a dehumidifier which is very very expensive and they wont cover the cost. They sent a maintenance guy and he says there is no smell.
Its really very difficult to live in the apartment with all smell and we really regret of moving there. I have taken a 6 months lease and just 2 days have passed. The agreement states to break a lease I have to pay 2 months rent along with 400 $ deposit will not be returned. What are my rights and how should I proceed with the issue?
