Animals (2 Dogs) Noise Complaints

Hello,

My Fiance and I moved into an apartment that was a good deal at the time and live on the 2nd floor.  Unfortuantly it has been H@!!, since we’ve moved in.  We have a small Rat Terrier/Chiu Mix that is well trained and have only been here for 3 months as of December 8th, 2010.  We have made two complaints to management about our 3rd floor neighbors and their Scottish Terrier (2) dogs.  The 3rd floor dogs run around like elephants on a parade and shack our apartment and wake us in the morning.  Management has stated that they have contacted them about the noise and have not seen any changes.

When we first signed the lease the new manager had stated the apartment complex is under new management and that all complaints will be dealt with and have seen no changes.  (I have previously lived here before and had the same issues and nothing was ever done.  Shame on me twice of course and not following my gut).  What can we do as renters to get management to take action with the 3rd floor dogs?

According to the lease agreement it appears they can make any changes to the "Animal Rules" clause/agreement at any time.  Do we have a chance taking legal action and making sure that the apartment is doing their part?

If not, how can we go about getting out of this apartment legally?
