Bed Bugs New Apartment

I moved into an apartment in June 2010 in the DU area in Colorado.  After 2.5 weeks of living there, I woke with bed bug bites.  I reported this to the apartment management company and they have now treated 2x.  After the first treatment, they insinuated that I had brought them in as they "had never had problems before". I found this to be incorrect as the apartment is listed on the bedbug registry online and other tenants have confirmed that they have had their units treated. 

After the 2nd treatment, they identified the source of the infestation and have both evicted the tenant and treated the nest.  Unfortunately, this has not taken care of the entire issue as I have found more bugs in my apartment.  After speaking with another tenant, I learned that this apartment had been treated 2 separate times in March 2010.  When I confronted the apartment manager with this information, she said that they thought they had taken care of the issue. 

Had they notified me that this was an issue, I would not have signed the lease.  What are my rights regarding this?  Did they have the responsibility to notify me of the problem?

Bedbugged!!

Yes, your landlord should have informed you of the infested apartment prior to renting it to you. You have clear evidence that the problem was pre-existing and that your manager did have knowledge of the infestation.

Since the landlord knowingly rented you an apartment that was infested, you can do several things:

1) Demand full treatment at their cost.
2) Demand reimbursement for any damage
3) Demand rent abatement for the time you were not able to use the unit
4) Move. (but NOT until the bedbugs are gone, or you will take them with you)

Since you are dealing with bedbugs, you will probably want to file a bedbug complaint with the RPA. There is a link at the top of the page to file a complaint. When filling out the complaint form state what you think the landlord should do to make this right. Remember, they were the ones that brought this hardship upon you.

What is the landlord-tenant law? Where is it stipulated that they were required to provide me with this information? I need all the support I can get with these people.

There isn’t really a specific landlord-tenant law for bedbugs. At least not in Colorado. The laws haven’t caught up with the bedbug infestation problems. You won’t find much on the books about it.
