Can I get out of my lease?

Does anyone know if I would be able to get out of my lease – legally, without having to pay extra reletting charges/etc?

My boyfriend and I signed our lease in June of 09 for 6 months. The lease states the rent is for $700 a month. My boyfriend, who’s also on the lease pays the rent through their online system. I went to check it today, and they are actually charging us $705 a month ($5 more than what is stated in the lease).

We are desperately wanting to move out asap, as their has been a lot of criminal activity in our apartment, and I do not feel safe.

Any help would be greatly appreciated! Thanks.

Kim,
To legally get out of any lease you will need to prove that your landlord or property manager’s have breached or broken the contract. Otherwise, you are the one that would be in breach of the contract. Now, don’t stress yet. There are still ways around this.
One option would be to hire an attorney, but lets be honest, if you had the means to do that it would be a lot cheaper to pay the lease termination fee than to hire an attorney to help you break your lease agreement. The second and most likely the most affordable option would be to mediate through the RPA. It will cost you around $30, but they will contact the manager to discuss some fair lease termination terms, and hopefully be able to get management to agree to let you out of the lease due to safety concerns. Think about, once its documented (via RPA) why would a management company want the risk of requiring you to stay even though you don’t feel safe? It just opens the doors to nasty lawsuit.
Thats what I’ve got for you. In Texas everythings bigger, even your rental contracts! :)
