Can they take away my promised apartment?

HELP!!!!!!! Two weeks ago, I went in to an apartment complex north of Indianapolis.   I am trying to get out of my house and into an apartment for many reasons.      Because I have two kids, I was excited to see that the complex had an apartment floor plan that was slightly bigger than my small ranch home.     It was on the second floor and available June 1.    Perfect!!!

I paid the deposit, got my new address along with contact information for the utilitities.  We visited a similar apartment so that I could get measurements for furniture, etc.  I was moving!!!!!!

Two days later, I received a call from the complex stating that they had to move my move-in date back to June 15….Again, not a problem, I’m a school teacher and that gives me more time when school is out to get packed.

Yesterday, I received an email saying that the renters that are currently occupying have decided to stay and that they were putting me in a smaller floor plan (that doesn’t suit my family’s needs).

Called them back today and was told that they can’t make those people move out and there is nothing else available in my desired floor plan.   They can call their sister company and put me elsewhere in my city.    Again, not what I paid my deposit for and was promised.

Do I have any recourse?   Since the current renters signed a Notice to Vacate and I was given that address, isn’t there something that can be done?

Have you signed the lease agreement already? Quite a ran around. Since you paid for the deposit I would say you did and I think aside from making arrangement or talking to the landlord you can file a complaint here with RPA for more help.http://www.rentalprotectionagency.com/complaint_center.php. Fill that out and agent will take care of it.
