hello on september 5th we had a flood in my neighborhood, the house that i am renting was flooded very bad i notified the landlord the next day as soon as we could get in the house but i am sure that she heard it on the news. i called sears to come out and clean the carpet they told us there was nothing they could do becuase of the water damage so i told her that she should call the insurance because sears said that the water was under the pad but the landlord informed me that she doesnt have insurance but the house has a mildew smell not to metion that most of that water in the house was probably from a creek that flows a few blocks away so it is a very unsanitary home now i want to move but she wont give me my money back, i am only asking for my deposit back she also wants to charge me rent since i havent moved out yet, what can i do what are my rights?

Your landlord is not entitled to pay for any damages because of the flood. If it is something that she could have prevented then she is liable, but flood because of a storm or any calamity is not her responsibility.
