Help! Roaches!

I recently received keys to my apartment August 6, 2012, and I was extremely excited! All excitement ended as I entered the property to find it dirty and with roaches! I notified landlord of roaches the same day and complained again on the 7th. They promised to send a pest control company out the 15th. I was totally disgusted and upset because I now had no place to sleep! I began research on how to break my lease legally. I found out I could give them a 5 day notice. Kansas law states if an apartment is not ready to move into on the day of your lease beginning you can terminate lease within 5 days. Kansas law also states roach infestation is terms for terminating lease and you are to receive your full security deposit and first months rent back. You can also ask for additionsl costs such as moving, storage, etc. So on August 10, 2012 I served them the notice, as well as my keys to the apartment. Landlord denied the notice and sent out a letter telling me I would not receive my deposit or rent back. She also said I must still abide by terms of lease and she will begin trying to rent the apartment. I don’t care if she rents the apartment but I will not pay rent when the law clearly states I should be released from my lease. I need to know if I should seek a lawyers help to receive my mo du back in full!!
