How long can I be away?

In the first week of April in 2011 on her deathbed, my grandmother asked that I move into the condo with my brother and sister in order to helpr with my grandfather who has dementia and is bedridden.In late March 2013 my grandfather went into hospis care. On april 5 2013 my brother gave me a 3 day notice, even though I was taking care of my grandfather in exchange for rent, and this is after changing the locks on me Earlier today I saw my bedroom window open and I went through it. The police said later that because I havent been there for 28 days I forfiet my tenency. If I was given a 3 day notice on April 5 and today is May 2nd, how is this true?
