Is this fraud?

My daughter rented an apartment in Fredericton and was there for over a year.  Myself and another friend went to Fredericton and cleaned the apartment after she moved.  There was a burn mark on the bathroom floor from an iron, floor approx. 5 x 7 that I knew she would have to loose some of her $800.00 damage deposit.  However we received a Notice stating that there was $1351.75 worth of damage.  $900 of that was for the replacement of the bathroom and very large kitchen floor.  Much to our alarm new floors were never laid in the apartment and most of the pictures sent to us were of marks on the walls that were to be painted as a routine matenance that they have to do according to the lease aggreement.  We have taken pictures to prove that no new floor was laid.  Is the some type of fraud?
