Kicked out illegally?

By Rachel Kodner

I used to lived at 6130 N. Rockwell, Floor 3 (Chicago, IL) for about a year and 4 months. The landlord, Sebastian Toma, lives on the first floor of the building. He was constantly coming over unannounced. My boyfriend mentioned to me that what the landlord is doing is illegal. He has to give you notice before coming over unannounced. So I looked up the Chicago laws online and it does say that the landlord has to give 24-48 hours notice. I told the landlord this and he said I know what the laws say, and I own the place, so I don’t have to give notice. And it’s not like I’m going into your bedroom. I’m coming into a shared living space.  (The third floor could house up to 3 separate roommates, including me, each with their own separate bedroom and separate lease. And the kitchen/living room/dining room are a shared space). Regardless of shared space, and regardless of the fact that he owns building and lives there, the laws still state that he has to give 24-48 hours notice, right?
So he did this a few times, and one time I had left some very expensive video equipment in the dining room and went to work because I assumed no one would be there while I was gone. And that afternoon my roommate and I got a text from the landlord saying he was bringing someone over in 30 minutes. I was really upset that my gear was left out and he was coming over announced.  Both my roommate and I spoke up about our displeasure with the lack of notice. The landlord got really mad at me and told me this was out of control and told me on August 15th 2013 that he was kicking me out and that I needed to be out by the end of September. I packed my things and was out September 1st. (Let me reiterate, he kicked me out because I kept telling him he was breaking the law).
I texted him once I moved out to let him know I was gone. His EXACT text back to me said "I didn’t expect you to move until the end of September. You were supposed to give me notice of moving, but I’m okay with it."  HE JUST SAID HE WAS OKAY WITH IT. So I asked for my Security Deposit back and he asked for a forwarding address, and I gave it to him. A week later the check hadnt showed up and I asked him when he was going to send it. He refused to tell me. He said "That’s not how it works, look up the rules for security deposit refunds online. I have 40 days. I also needed a notice from you that you are moving out."
First of all, I’ve looked up the rules online before, concerning coming over unannounced and they say 24-48 hrs notice, and despite looking up the rules, he doesn’t abide by that, so why would I look up more rules online that he would just contradict? I wrote back and said "in your last message you said it was okay about the notice. So I’ll anticipate the check 40 days from when I moved out." He responded "I was ok about you moving out, not the lack of notice." (THATS NOT WHAT HIS ORIGINAL TEXT MESSAGE SAID, HE’S BEING A HYPOCRITE NOW.)
So let’s get into what other rules he broke. There was no smoke detector anywhere on the 3rd floor (the apartment I lived in) for at least the first year I lived there. That’s HIGHLY ILLEGAL. I had to push him several times to install a smoke detector in the kitchen (which is right next to my bedroom). He didn’t install the smoke detector until June 2013, and I originally moved in on April 2012.
Now this is where it gets murky. When I first moved in, I signed a lease that only lasted so long. I never got time to re-sign the lease once it expired and the landlord was okay with that. He said we’ll just do a month-by-month lease basis, or as he called it, a verbal agreement. So I wasn’t on a lease when I was kicked out. But I feel that I was kicked out illegally, and now I’m scared he’s going to hold my deposit and not give it back because I didn’t give notice of moving out 30 days early even though I was kicked out and even though his initial text stated he was okay with me not giving notice.
I want to mention that I have GLEAMING REVIEWING from all my previous landlords where I paid wayyyyy more money at other apartments. I’ve never ever had any issues with landlords until I had to deal with Sebastian Toma, which tells me it’s not me that’s the problem. It’s him. I believe he’s mad that I challenged his authority and that’s why he kicked me out.
What can I do? How can I file a complaint against him? What governing body can help me get my security deposit back?
What services does Rental Protection Agency offer? What can they do to help me in this case?
