kitchen fire with faulty extinguisher

i rcntly had a small kitchen firr which i was at fault for but when i went to usr my fire extinguisher it did not function properly. upon further inspection i found it hadnt been maintenanced in almost 2 yrs when state law requires maintenancing every year. is it possible to take legal action?
