Landlord Cancelled Lease

My husband and I were approved by a reputable national relator to move into a home a few weeks ago. We had paid a pet deposit and paid a full months rent down as a deposit on the home. I have had utilites transferred and a day before we were to move in the realator calls to tell us that the owner has decided to sale the home and we can no longer move in. We have already signed a lease and delivered the requested deposit to hold the home. Can they legally do this?

It depends on what the lease agreement says. Most likely the lease you signed with the landlord is binding and can be enforced. However, read the agreement to see if it says anything about possesion– many times there is a clause in the lease agreement that will allow the landlord to refund your deposits prior to possession.

Hey have you gotten your deposit back yet? Thats the main question. If they are slow to refund your deposit, I would file a complaint with the RPA. Who knows what they can do? I would focus on finding a new place to rent.
