Landlord Deducting Excessive Money from Security Deposit. Pls advice

We left the apartment in December 2010. At the time of final walkthrough, Appt Manager said only cleaning fee will be charged.

 

When I received the response after over a month

 

1. They deducted about $600 towards replacing the carpet for normal wear and tear and additional $275 for cleaning. 

2. Charged us for $271 for a normal service call during our stay and never told us while we were living there.

 

3. There was a small damage done during the first month of our stay. The manager never gave us the bill for pay. But after 3 years of stay when we decide to leave, he is asking us to pay the bill for the damage than over 3 years ago.

 

4. Their response is that they make a file and add these expenses to it and only let the tenant know when the apartment is vacated and the amount is deducted from the deposit.

Any advice ? I have already written letters but no resolution yet

That sounds like a rip-off. In situations like these, you need to always refer to your lease agreement. So what does it say? Normal wear and tear should not be charged. If there is a need for carpet replacement and it was charged to you then that could be because of some major damages that you did. For instance, stains and pet marks. If these are not present, then you should not be charged. Again, look at your lease. It is a legally binding agreement and that should help you out. If you have documentation of the state of the rental before and after you moved, that would also be handy. You can also file a complaint against your landlord.
