Landlord threatening to evict

By anonymous

Is it legal in the State of Kansas for a Landlord to threaten to evict because a tenant complains?  I recently had a flood in my duplex because of excessive rain.  When I first asked my landlord to remove and replace the carpet in the basement because of how bad the flood was, she told me that she would raise my rent if I wanted her to do that.  She asked around and some of her friends told her that she had to remove the carpet and replace it because the carpet had been soaked for over 7 days and was starting to mold and smell.

She called me to tell me that she would be having someone come to my home to replace my carpet and that they would come after I got home from work.  When I got home from work I noticed that the carpet had already been replaced and upon going into my kitchen to get something to drink for my children, I noticed that food and drinks were missing from my refridgerator that my children and I had not touched or even opened yet.

I called my landlord to tell her that the people that came to fix the carpet had stollen food and drinks from my kitchen.  She told me that I needed to give her a 30 day notice to move out.  I explained to her that I was not saying anything about wanting to move but that I was reporting to her that the people she hired to do work in my home had stollen from me.  She then told me that she didn’t believe me because she had known those people for 10 years and didn’t think that they would do that.  I told her that I knew what I had in my kitchen and they had no right to take anything from it.  She told me that she was going to give me a 30 day notice to vacate.  I told her that she was making no sense, I should be able to make that complaint to my landlord without being threatened with eviction!  I told her that all I want to happen is that anytime something needs to get done at the home that I am paying rent for, not to have anyone there unless I am there.

She told me that if that was what I wanted then she better not get any complaints about how long it takes to have things fixed.  I told her that if I give her reasonable notice then she needs to respond in reasonable time.  I told her that I would put my complaint in writing and she told me that if she didn’t feel that having them not come into my home unless I am there works, she was going to go ahead with the 30 day notice for me to vacate the home.

Can she legally put me out for making a complaint of theft?
