Mouse Problem in Apartment

Hi Everyone,

 I am a tenant at a community in Dublin, CA and since day one of moving into this unit, I have been having maintenance issues. In the past eight months (since I moved into the unit in January of 2011), the maintenance team has entered my apartment more than TEN times for issues. This is more than I ever called or involved maintenance at all the communities that I lived in before combined.

However, the worst of these issues is the one that started about a month ago, which is a mice problem. It began after construction started on a piece of land not very far from this complex. When we first discovered the issue I called on a Thursday to report it and the management said that they will send maintenance on Monday to seal holes and that they would send the pest control person the next day on Tuesday. So, on Monday they came and ALL they did was seal the hole under the kitchen sink and they put a couple of traps in the kitchen. The next day, the pest control guy came in and put more solid traps and left. Within three days or so, we caught THREE mice and threw them away. Unfortunately, the problem wasn’t over. There were more mice still coming in.

On Friday, my wife saw a couple of more mice, and so I called in after she discovered that around 4:00 PM to report this and they sent the guy at 4:50 PM and all he did was put more traps. Even though, I clearly requested that they check for more holes and seal them but they did NOT treat it as an emergency and he was in a hurry to go home. He did NOT even have any tools. He just put more traps and left. I was really upset to know that he didn’t try to identify more holes and so on Sunday we found a mouse caught in one of the traps in the laundry room. At this point, I became really upset and I actually physically went to the office and requested from the person there to call the manager since she doesn’t work on weekends. He called and left her a voicemail and said that he would get back to me when she called back. So, I informed him that this is an emergency and that he needs to call her back and let her know that and that I am not leaving until I talk to her.

Then, she called with an attitude (which is very common with this management staff) and I spoke to her in a very firm way and told her that this is completely unacceptable and that they need to send their emergency maintenance. So, she agreed and they sent another guy to look at the problem. He found out more holes in the apartment in the corners of the base boards and so he put foam and left. Also, he found a hole around the AC unit in the cabinet in the apartment. The next day, I requested from the manager herself to come in so I can show her the holes that this guy had found. She agreed and came in with her maintenance guys and I showed them these holes. Then, they sent a guy to vacuum and then they came to seal these holes with steel wool. They sealed the holes except the one around the AC unit claiming that the foam should be OK for now. Also, they refused to fix the base boards, which is something I requested when I first moved in because there were gaps in the base boards. They only did one side of the dining room and refused to do the rest of the apartment. 

I requested professional carpet cleaning to get rid of the smell from the  poop and urine of these mice and so she agreed to honor that. But, I wanted to wait to make sure there are no mice at all.

After that last visit, which was approxemately 2 weeks ago, we did not see any mice and so the carpet cleaning guy came in on Thursday (three days ago) and cleaned the carpet. To my shock, yesterday my wife saw two  more mice under the kitchen cabinet and I am soooo frustrated and upset at this point.

When I requested from the manager to move us to another unit she said that it would have to be on my expense and that the rent will go up since I have a deal/promotion on my current rent.

Please note that my wife is PREGNANT and DUE in 2 weeks and I still have four months on the lease.

WHAT DO I DO AND WHAT ARE MY RIGHTS AND WHAT SHOULD I REQUEST?
