Problem with smoker living above me..

In June 2010 a new tenant moved in an apartment above me. This lady smokes and she smokes like a choo-choo train.  She also smoke dope and all of this stuff stinks.  I have asthma and now the smoke is coming into my apartment.  Everytime the air comes on the smoke comes into my apartment.  What can I do about this, I have lived in this apartment for 5 years and everyone that lived above me never smoked. What are my rights to this problem.  Someone please help me with this situation..

I moved in August 2010 and shortly after moving in discovered the tenant below is a heavy smoker, cannot open my windows. I have asthma. Owner/Manager acknowledges the problem. What are my rights, I cannot live this way. What agency can I report so the owner knows that he entered into an agreement in bad faith.
