Problem with Swimming Pool

We are currently renting a home, our lease is up at the end of this month (July 2010) and the landlord (via Property Mgmt. co.) decided he did not want to renew our lease for whatever reason.  We have a pool, but for the past 3-4 weeks, the pool pump has been non-functional and we have been unable to swim in it.  We turned it in to the property managment company, they turned it into the home warranty company, and they are not fixing it.  We were expected to pay the full amount for our last month’s rent regardless.  We have had a lot of issues with this pool over the course of the lease and I have all of the emails to the prop company to back this up.  My question is:  can we get some sort of compensation on our rent (that we’ve already paid for the last month) because we are paying a premium to rent this home due to the pool and we can’t even use it??  Houses the size we’re in w/out pools are going for about $500-600/mo. less.

I had a rental property with a pool… I can tell you that there are a ton of things that can go wrong with swimming pools. I eventually sold my property and was glad to be releaved from my pool.

If you are renting a property with a pool and paying more for it because of the pool, you would be entitled to some type of rent abatement. It will be difficult to get your landlord to work with you; so you will probably need some type of legal help. I really don’t think it would make much sense to hire an attorney… but you could very easily file a complaint with the RPA. There’s a $35 filing fee, so its not really a big financial hit. When you file the complaint you will be assigned to an RPA Mediator whom will negotiate with your landlord to find some type of resolution.

I have 2 questions.
We rented a house last year with a pool and spa. We had not used the spa for almost 2 weeks and when she came to do the walk through, it wasn’t working. She says that we are responsible for the repair. I don’t see how.
The other issue is the maintenance/chemicals of the pool. We stopped using it and putting chemicals in it for one week while we moved out. She said she can charge us for the cost of chemicals to get it up to par. I can’t find where this is true or not.
