UNFAIR EVICTION

HI MY BUILDING MANAGE WANT TO EVICT ME ON GROUNDS MY GIRL FRIEND IS NOT ON THE LEASE AND ALSO NOISE COMPLAINTS,THIS IS MY SIDE OF THE STORY MY GIRLFRIEND DID TRY TO GET ON THE LEASE SHE WAS ON APROVED BACK IN OCT 2011 AT THE TIME THIS HAPPENED I ASKED MANAGERS BOSS WHO WAS IN THE OFFICE AT THE TIME DOES SHE NEED TO LEAVE THE MANAGERS BOSS SAID NO SHE CAN STAY ALSO EACH MO THE COMPLEX SENDS THE WATER BILL IN BOTH OUR NAMES WERE DID THEY GET HER NAME FROM ITS ON THE BILL, TO THE NOISE COMPLAINT MANAGER SAYS SHE SENT OUT TWO WHEN I ASKED TO SEE A COPY BEING I NEVER GOT ONE SHE COULD NOT FIND THEM AT THE TIME THIS IS A DOWN TOWN HIGH DOLLAR APARTMENT BUILDING I LOVE THIS PLACE SHE WANTS ME TO LEAVE ON MY OWN WHAT CAN I DO .

look for a low cost attorney on line. I am using an attorney on line and how it works is you become a member for a small fee and then if you use the service (they give you the name of an attorney that suits your needs, like an eviction attorney and then, you pay a reasonable monthly amount for the help; hope this helps


unfair eviction

I am renting an apartment and had a uninvited person enter my apartment and begin to threaten me and destroy some of my possesions…..the cops were called when I protected my self with revealing a weapon (gun).  I have now received an eviction notice and held responsible  for the disturbance.  What are my rights. The cops stated that I had every right to protect myself.  I do not feel that I should have to vacate and uproot my life for defending myself when that would be the normal reaction of anyone.

Mary, you must be some tough chick! I feel like I’m not getting all of the story. My first impression is that something is missing here. Why would you say the person was “uninvited” as opposed to “Burglar” or something along those lines? The wording you use does cause me to think that the individual may have known you some how and specifically came to your unit to cause problems rather than just some random crime.

Does it matter? Sure! If this is a person you know, it is much different than if it was a random crime. If you know the individual then, the property manager is wise to evict you. Look at it this way: If you weren’t living there, would the crime still have happened? Or is it because someone (friend, relative, etc) sought you out?

Do you see how you can actually be responsible for the disturbance even though the person was “uninvited?” The fact that you carry a gun may indicate that this type of thing is common or more likely to happen to you due to your lifestyle.

If this whole thing is due to a random crime and you were nothing more than a victim; then your landlord should not be able to evict you, even if you pulled out a gun. Owning a gun is your right and you can use it as self protection as mentioned by the police officers.

Can you give some more background on your story? We can’t really help answer your unlawful eviction question unless we have more facts.

Landlord says he received several complaints about me and my guest smoking weed in my friends car , i smoke cig in the car but never weed i collected evidence for my informal hearing for section 8, landlord came with no evidence.

My son, age 25, is renting a duplex with two other friends. Yesterday he told me his landlords (husband and wife) called him and had him on a speaker phone. The landlords said there had been two complaints from neighbors — one where police were called — and if they receive one more complaint, they would be evicted. The complaints were that loud noise and music was coming from the direction of their duplex during the night. My son tried to explain that he and his roommates were not the ones responsible for the noise and music, that they live in a duplex, and it was probably coming from the apartment attached to theirs. No police came to my son’s place, and he didn’t know anything about it. He said he and one of his roommates were asleep that night and the other one was not home. The landlords didn’t seem to want to consider he and his roommates were not responsible and told him they’d have to leave if they received one more complaint. They have 10 months left on this lease and they like the place, but he doesn’t want to have to live with the threat of being evicted over something he has no control over. He said he will talk to the people in the next apartment and let them know what the landlords are telling him, but there again, he really can’t control their behavior. What recourse does my son and his roommates have in a situation like this where the landlords are unfairly threatening them with eviction for something they are not doing? Thank you for your help on this.
