Unfair rent for current residents

I have been living a 1-BR apartment in Falls Church, VA since about an year.  The stay in the apartment has been good until now without any major problems.  I want to upgrade to a 1-BR w/ Den apartment.
The apartment is offering discounted rates for new residents.  When I asked the leasing office about the pricing they said I would not get any of the discounts they are offering new residents, because I have been living in the apartment complex from before.  They said in order to get those discounted pricing I will have to move out of my current apartment and reapply for the new one.  Also since I am re-applying, I will have to pay a one-time fee of $250 for the gym facilities and $50 application fee.
I want to know if this is allowed under current laws.
