What are my RIGHTS

My problem is alittle long. I have rented a space for a bussiness and for my living space for the last year. When we looked into renting the spaces on of the things the landlord told us was all utlities were included and that she also had control of the temputure of both spaces. I informed here that the product that I would be selling for my bussiness down stairs had to be climate controlled because it could go bad she assured me that would not be a problem. Now for the most part that was true, we did have to call her a couple of times and let her know that it was to warm. Now this year as soon as it got warm I remineded her that the warm weather was comming and could she please be aware. needless to say as soon as this came out of my mouth she informed me that she was not going to pay a 400.00 bill this year for running the ac. well we had to get the leasing agent involved and hold the rent last month for 4 days until she had her duct work fixed in the store that is downstairs which did fix the problem so much so that I had to start wearing long sleeve shirts to work which is fine. also we gave her a 200.00 dollar amonth increase in rent for the summer months to make sure that the store was kept at a cool temp. now we also had a addium to the contract drawn up stating that she would keep the store temp at around 72 and no higher then 75 well now for the last two weeks the store has been 72 first thing in morning after being closed all night and gets to 75 during the day. I dont set at a desk all day. I have customers comming in and out all day. Now the problem that I have is my living area is upstairs and when it reaches 75 in the store it is 80 in my apartment so when I get home it is to warm to cook or clean and it is also affecting my sleeping. I am over weight I am working on losing weight and have lost about 70lbs over the last year, but it is still not comfortable when I come home to a temp of 80. what are my rights?

What are MY rights?

I moved to an apartment compex in Arlington Hts IL on August 1 2009. We moved in with 2 dogs. An Akita and a Poodle mix. When we originally signed our lease the management company needed to know breed, wieght and have a photo of each dog on file. Well some time this year (2010) our complex was bought out by another management company. The new company posted a notice on our door that our lease was due for renewal and if we renew before July 15th that we would not incur any rent increase. That was fine.

We had our appointment to sign the new lease on Saturday June 26th. The tenant manager asked if we still had our two dogs at which time we confirmed. She asked us to confirm the breeds and when I mentioned that one of our dogs is an Akita she stopped the meeting and pulled out a print out with a list of the "10 dogs considered dangerous" and my dogs breed was on it. According to the rental manager because our dog is "banned" that we can not sign a new lease and must either vacate the property or get rid of my dog. I have until July 2nd to submit my decision and if I can not relocate my dog then I MUST vacate by July 31st. That leaves me 35 days to search, find, view, apply for, and coordinate a move. Can they really do this? Cant I be grandfathered in under the previous policy considering I have NEVER paid my rent late nor have I done any damage or had ANY complaints toward myself my pets or my guests?

Also I have a neighbor that also has an Akita and they allowed her to renew her lease on June 1st. JUST 25 DAYS AGO!!!! She even spoke to the exact same person that we spoke to in the leasing office!! What can I do? What are my rights?

❓ Sorry, when it comes to dogs, there are no renting rights.  Your landlord does have right to refuse your renewal if you don’t get rid of your dog.  In fact, even if you had a poodle, they could legally still refuse your lease renewal ❗
 
Its a dog eat dog world in the rental industry.  When it comes to pets, it can be a crap shoot.  From lease to lease your property manager can change their pet policies.  I think what they are doing is unethical since you have lived there for a while, why not place these rules on new tenants and let the current ones ride; I don’t know.  I guess that’s golden question.
 
So what can you do?  With this short of notice… not much.  I would start looking for a new apartment.  Even if you get management to accept this year, there is no guarantee towards next year.  It really is a lease by lease condition, and since its not a protected class– your doggy could be doomed. ❗
