Ant infestation

My cousin lives in an apartment that is infested with ants. they are comming out of the shower head, in the base of their cupboards it looks as if the base is alive with the movement of the aints. they have had the apartment management come and spray numerous times but nothing is working. they are wanting to break the lease without penalty. Management is telling them that they can not break the lease without penalty so my question is since the management has not been able to resolve this issue do they in fact have the right to break without penalty
